Nucifra Terms of Service

These terms are an agreement between you and PT GLOBAL RAYA ORIS WIJAYA. They govern your use of Nucifra, an S3-compatible object storage service for AI agents. By creating an account or using the service, you accept these terms.

01. Definitions

“Service” means the Nucifra object storage service, its API, its MCP server, its web application and its documentation. “You” or “Customer” means the person or organisation that holds the account. “Content” means any file, object, metadata or other data you or your agents store through the Service. “Bucket” means a named container for Content. “Public URL” means a time-limited presigned link that grants read access to a single object. “Agent” means any automated system, including an AI assistant, that you authorise to use your credentials.

02. Accounts and eligibility

You must be at least 18 years old, and you confirm that you have the legal capacity to enter into this agreement. If you register on behalf of a company, you confirm you are authorised to bind it. You must give accurate registration details and keep them current.

You are responsible for all activity under your account, including activity by your agents and by anyone holding your API keys. Keep credentials confidential and tell us at support@nucifra.com without undue delay if you believe they have been exposed.

03. Free plan

Every account starts on the free plan: 1 GB of storage, 100 objects, and no payment card. The free plan is limited to one per customer and carries lower rate limits than a paid plan. We may end or restrict a free account that is used for abuse or to circumvent paid plan limits.

Add a payment card and we raise the account to 10 GB of storage, 1,000 objects and a 30-day object life, still charged at USD 0. You pay only when you choose a paid plan.

We pause a free account that has had no sign-in and no API call for 30 days, and we delete every object in it. We email you seven days before that date. Sign in, or make one API call, and nothing is deleted. We keep the account itself, and you can resume it at no cost.

04. Plans, fees and taxes

Plans are billed monthly in advance in US dollars. Current plans:

Every plan includes unlimited outbound bandwidth, subject to section 06. Section 07 explains object life and the charge for storage above the quota. Prices exclude tax. Our merchant of record calculates the sales tax, value added tax or goods and services tax that applies where you are located, adds it at checkout, and shows it on the invoice it issues to you. See section 05.

We may change prices. For existing customers we will give at least 30 days notice by email before a price change takes effect, and the new price applies from your next billing period after that notice.

05. Payment and merchant of record

Payments are processed by Armitage Labs OÜ, an Estonian company that operates Creem. Creem acts as the merchant of record for your purchase: it is the seller for that transaction, it issues the invoice or receipt, and it collects and pays the tax due where you are located. Your agreement for the Service itself, including these terms, is with PT GLOBAL RAYA ORIS WIJAYA.

We never receive or store your full card number. You authorise recurring charges for your plan until you cancel.

If a payment fails we will retry and notify you. If the invoice remains unpaid seven days after the due date we may suspend uploads and API access. If it remains unpaid 30 days after the due date we may terminate the account and delete Content in line with section 13.

06. Unlimited bandwidth and fair use

We do not charge for outbound bandwidth on any plan, and we do not meter egress. This applies to normal use of the Service as storage for your own Content, including repeated fetches of the same object by advertising platforms and other systems you integrate with.

Bandwidth is not a general purpose content delivery network. We may rate limit, throttle or suspend an account that uses the Service primarily to serve a third-party media library, to host files for unrelated websites at scale, or in a way that materially degrades the Service for other customers. Where practicable we will contact you before acting.

07. Storage limits, object life and overage

A free plan stops at its limit. When you reach 1 GB or 100 objects, we reject new uploads until you delete objects or move to a larger plan. We do not delete Content because you reached a limit.

A paid plan does not stop at its limit. We charge USD 0.25 for each GB you store above your plan’s quota, for each month, on your next invoice.

Every object has a life, set by the plan it was uploaded on: 7 days on the free plan, 30 days with a card and on Starter, and 90 days on Pro and Team. We delete an object when its life ends. This is how the Service works; it is not a fault. Keep your own copy of Content you need to keep.

08. Public URLs

A Public URL is a presigned link that is valid for one hour by default, and for as long as seven days where you ask for a longer life when you create the link. Anyone holding the link can read that object until it expires, without logging in. Treat Public URLs as secrets and only share them with systems that need the file.

You decide which objects to expose and to whom. We are not responsible for the consequences of a Public URL you or your agent shares, including onward sharing by a recipient. Expired links return an HTTP 403 response; generating a new link does not change the underlying object.

09. Your Content

You keep all rights in your Content. You grant us a limited, worldwide, royalty-free licence to host, copy, transmit, cache and display Content, and to create technical derivatives such as video thumbnails, only as needed to operate and support the Service.

You confirm that you hold the rights needed to store and distribute your Content and that doing so does not infringe the rights of others or breach any law that applies to you. We do not use your Content to train machine learning models and we do not sell it.

10. Acceptable use

Your use of the Service is subject to the Acceptable Use Policy, which forms part of these terms. Serious breaches, including child sexual abuse material, may lead to immediate termination and reporting to the authorities.

11. Third-party services and infrastructure

The Service runs on third-party cloud infrastructure and works with third-party clients and platforms, including MCP clients, S3-compatible tools and advertising platforms. We are not affiliated with, endorsed by, or acting as an agent of those providers. Their terms govern your use of their products, and changes they make may affect how the Service works with them.

12. Availability, support and changes

We aim for high availability but we do not commit to a specific uptime percentage or service credit under these terms. We may perform maintenance, and we will publish planned maintenance that we expect to interrupt the Service.

Support is provided by email at support@nucifra.com during business hours in Western Indonesian Time (WIB), Monday to Friday. We may add, change or withdraw features. If we withdraw a feature you rely on materially, we will give at least 30 days notice by email where practicable.

13. Suspension, termination and deletion

You may cancel at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account if you breach these terms or the Acceptable Use Policy, if payment is overdue, or if we are required to do so by law.

After termination you can export your Content for 30 days, unless the termination was for a serious breach that makes immediate deletion necessary. We then delete Content from live systems within 30 days and from backups within 90 days. Deletion of an individual object follows the same timeline.

14. Intellectual property

We own the Service, its software and the Nucifra name and marks. These terms grant you no rights in them beyond use of the Service. You may not copy, resell, reverse engineer or attempt to derive the source code of the Service, except where that restriction is void under applicable law.

15. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that a third-party platform will accept a file you store with us. You are responsible for keeping your own copies of important Content.

16. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, loss of profit, loss of revenue, or loss of data value. Our total liability arising out of or in connection with these terms is limited to the fees you paid us in the three months before the event giving rise to the claim, or USD 100 if that is greater.

Nothing in these terms limits or excludes liability for fraud, wilful misconduct or gross negligence, for death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under the law that applies to you.

17. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from your Content, your use of the Service in breach of these terms, or your breach of the Acceptable Use Policy. We will notify you of any such claim and give you reasonable control of the defence, and you may not settle in a way that imposes an obligation on us without our consent.

18. Changes to these terms

We may update these terms. For material changes we will give at least 30 days notice by email to the address on your account and publish the new version with its effective date. If you do not accept a change, cancel before it takes effect; continued use after that date means you accept the new version.

19. Governing law and disputes

These terms are governed by the laws of the Republic of Indonesia. Before starting proceedings, the parties will attempt to resolve the dispute in good faith for 30 days after written notice to support@nucifra.com. If that fails, the dispute is subject to the exclusive jurisdiction of the District Court of Yogyakarta (Pengadilan Negeri Yogyakarta), without prejudice to any right a consumer has under mandatory local law.

20. General

These terms, the Acceptable Use Policy, the Privacy Policy and the Refund and Cancellation Policy form the entire agreement between us. Where your Content includes personal data, the Data Processing Addendum also applies and forms part of these terms. You accept it when you create an account, and no separate signature is required. We will sign a separate copy of the Addendum on request.

When you create an account we record the date, the address you connected from, and the version of each document in force at that moment. That record is how we both prove which version you accepted.

You may not assign these terms without our consent; we may assign them to a successor of our business. If a provision is unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.

Notices to you are sent to the email address on your account. Notices to us go to support@nucifra.com. These terms are written in English. If we publish an Indonesian translation and the two versions conflict, the Indonesian version prevails to the extent required by Law No. 24 of 2009; otherwise the English version prevails.
